Workmen's Compensation Fraud

What is workmen's compensation fraud?

Workmen's compensation fraud occurs when someone willfully makes false statements or conceal information in order to obtain compensation benefits, or to avoid making compensation payments. It is against the law for any person or entity to make any fraudulent claims or defrauding the Commission in order to obtain compensation benefits or to avoid making compensation payments. Fraud is considered a felony.

How can a fraudulent workmen's compensation claim be brought forth before the Commission?

Pursuant to A.S.C.A. §32.0654(b), the Commission may at any time, either on its own motion or upon the application of any party, reopen any case on the ground that fraud has been practiced on any party, and render such decision as is proper under the circumstances.
