Compensation of Medical Services on Claims by Employees of American Samoa Government

The compensation of claims filed by any injured employee of the American Samoa Government (ASG) is fully guaranteed under the American Samoa Workmen's Compensation Act unless such claim is disputed or controverted by the employer.

 

The compensation of any awarded workmen's compensation benefits, including medical benefits, are fully covered for payment under a special fund set by the statute specifically for workers compensation claims by employees of the territorial government (except for ASG departments and offices whose workers compensation liability are covered by an insurance carrier). Both the employer and the Commission reserves the right to review and dispute any medical billing or expenses submitted for payment claim by the employee.

Regardless of medical services for the treatment of the employee's work-related injury being rendered either locally or abroad, medical providers should be fully covered for the payments of such treatments and services as long the following conditions are met:

• The injured employee filed a workmen's compensation claim before the Commission.

​​

• The injury is not disputed as work-related, and the right of compensation is not controverted by the employer.​

​

• Claim for medical payments have successfully been mediated and approved for payments through an approved Interim Settlement Agreement or Final Settlement Agreement.

Currently, the Commission prohibits the submission of medical billings and the employee's medical records and related evaluations via online unless the Commissioner waive such restriction on reasonable justifications. It is the duty and responsibility of the claimant and medical providers to ensure all medical billings are provided to the Commission's Office to be forwarded before the Commission for review for payment.
