insurance policy & NOTICE OF COVERAGE

Requirements of an Insurance Policy:

A carrier securing authorization from the Commission to provide workmen's compensation insurance in American Samoa under the American Samoa Workmen's Compensation Act (ASWCA) is authorized to initiate and effectuate insurance policy or contract in the Territory. Under the ASWCA, any insurance policy or contract of insurance issued by the insurance carrier must contain the following:

  • A provision to carry out the Insurance Carrier's ability as prescribed under A.S.C.A. Section 32.0535 which is the substitution of the carrier for the employer as a liable party;

 

  • A provision that insolvency or bankruptcy of the employer, or discharge therein, or both, does not relieve the Insurance Carrier from payment of compensation for disability or death sustained by an employee during the life of such policy or contract.

Notice of Coverage Secured:

Any time a carrier successfully purchases or renews an insurance policy, the carrier is mandated to issue the employer a notice within 10 days to verify a policy coverage has been purchased and secured. This coverage notice is entitled as Notice of Workmen's Compensation Coverage Secured. Carriers are also obligated to inform and instruct the employer to provide a copy of the coverage notice to the Commission's Office to/and file a Certificate of Compliance.
