Payment Claims for Legal Fees & Other Services on Claims
before the Commission

Payment of Legal Fees or Gratuity for Services of a Claim.

The American Samoa Workmen's Compenstion Act prohibits the payment of any fees, other consideration, or any gratuity on account of services rendered in respect to a claim by a person who makes it a business to solicit himself, or employment for a lawyer, unless such gratuity or fee is approved by the Commissioner or court (whomever where the claim is deliberated). If approved, all such fees shall be lien upon the employee's compensation award.

Filing a Claim for Payment of Legal Fees or Gratuity before the Commission.

To file a claim for the payment of legal fees or other services rendered on a claim before the Commission, the applicant must complete and file FORM CS-01: Payment Claim for Legal Fees & Other Services with the Commission's Office. Claims for such payments must be filed with the Commission's Office within 10 days before the claimant's last hearing.
