​​​Exempted employers are referred to employers prescribed under A.S.C.A. §32.0521 being exempted from workmen's compensation liability. These employers are not required by law to obtain and secure a workers compensation insurance coverage. Nonetheless, exempted employers are still required to file a Certificate of Compliance (Exempt Coverage) in order to certify and verify its exemption status under the American Samoa Workmen's Compensation Act (ASWCA) with the Commission.​​

The following are considered employers exempted under the ASWCA:​

​​​

• Minor employers - those regularly employing 2 or fewer employees; and

​​​

• Any person employing individuals for whom the rule of liability for injuries is provided by the laws of the United States.

Other Requirements when Filing a CEC:

When filing a CEC with the Commission, the employer is required to submit and complete an EC-1 Form.​
